Introduction to Public Nuisance Dispute

(1) Purpose : To prevent and renovate soil and underground water pollution, ensuring the quality of the land and groundwater resources, improving the living environmental standards, promoting citizen well-being.

(2) Main Tasks:

  1. The public nuisance victims must submit the public nuisance dispute mediation application form to the Public Nuisance Dispute Mediation Department of Yilan county.
  2. The applicant of the public nuisance dispute mediation must submit mediation fee to the mediation committee.
  3. The mediation committee shall schedule the mediation date within one month after receiving the application.
  4. Mediation committee must meet to mediate the public nuisance dispute with application submitted. Specialists and scholars shall be invited to conduct investigation and verification if necessary.
  5. Mediation Results
    1. Established Mediation: The mediation result certification shall be sent to the victim within seven days after the mediation is established and the approved by the court.
    2. If the mediation is not established: The mediation committee shall send the result to the applicant within 7 days after the decision is made. The applicant can re-submit the case for a second mediation or to submit for judgment if the dispute is related to the victim compensation.
  6. Application for re-mediation: The applicant has 14 days after receiving the mediation result to resubmit the case for the second mediation. A request-for-re-mediation-form will need to be submitted to the Public Nuisance mediation committee of Yilan County.
  7. Submit for a Judgment: The applicant can submit the case for a judgment from the Yilan Public Nuisance Dispute Mediation Committee if the remediation is not established and the case involves compensation to the applicant.
    1. The judgment process and the decision: The judgment committee is made of three or five committee members appointed by the chairman. The judgment decision is made with a majority opinion.
    2. About the amount of compensation: If there are more than two suggested amounts and non of the suggestions receive a majority vote, then a revolt is needed with the first and second popular suggestions. A final decision is born after a majority vote is reached.
    3. The certification of the judgment results: The mediation committee shall send the judgment certification to the applicant within three months after the judgment about the case is made.
